Once granted, a European patent can only be annulled by separate proceedings in each elected country.

Within nine months after the grant of a European patent, anyone can file an opposition with the EPO, stating why this patent should not have been granted. The patent holder and the opponent can then debate with each other. Finally, the EPO will take a decision based on facts and arguments presented by both sides. Where in the United States, the challenger is not a part of these proceedings.
