Tcj just might want to mention that common shareholders are not under the bus yet. It depends on the terms of release from conservatorship, or what a SCOTUS decision were to decide (if the plaintiffs pursue it, which at this point I would assume so given the facts). If HERA was deemed unconstitutional, you could see a windfall, but I wouldn't count on it. Chances are this will get resolved before that happens.
Obit, is it me or once you bring a case before SCOTUS, it's not like you just say "nevermind" if later the two parties settle, correct? I imagine if it's a constitutional matter it's a big deal to get a hearing, and that to settle might show disrespect to the court. Unwritten ethics to see it through at that point?
