You have to file a Worthless Securities Authorization Form.

All brokers have something similar - here is the etrade form.

"Use this form if you want to relinquish a worthless security you hold and to authorize E*TRADE Securities or it’s affiliates, to sell the security for a $0.01 for the lot."

This shows the loss in your account so you can use the loss for taxes.
