As Chumba stated .. what trumps an appeal ? .. Fraud does .. thats for sure ... Hurely mentioned it three times or more in his opinion not to mention -- he believed nothing with the debenture fiasco .. he just didn't know why there was a problem with the debenture story .. well quess what .. Hurley was not fully informed .. and full discovery did not occur as is the duty of Offil/shinn and knight to present all discovery prior to the trial ... not after .. look at the brief filed by HtDs .. already one document shown up that wasn't given prior to trial that makes a huge difference .. how many more are there ? ... whats a rule 60 .. time to find out
