sneak, you appear to be saying...
that ERHC is now a "Smaller Reporting Company", which is a company with a public float of less than $75M (so ERHC would certainly qualify, although they did not check that box on the last 10-Q). However, from what I can find about Smaller Reporting Companies, while they are relieved of some of the reporting requirements in 10-Q's and 10-K's, the deadlines for reporting are still the same as for larger, non-accelerated filers, or 90 days for 10-K's.
If you could post a link to show different reporting deadlines for Smaller Reporting Companies, that would be helpful.
