Hard to say. As everyone knows, the action was eventually settled; the parties gave up and walked away. That happens pretty often, because litigation is expensive. As described in the portion of the complaint you cited, it seems the plaintiffs accused Neubauer and others of lying about the viability of Planet, and of pumping the company and the stock in various ways.

An SEC action is also referenced. It also involved flagrant pumping, in that case in the form of massive fax blasts touting ArTec and Sequoia Interests Corporation. Oddly…

In March of 2007 an article disseminated by Neubauer stated that he as well as other current Planet officers previously worked for Sequoia Interests Inc. Remarkably Planet's Petroluxus registered trademark and the registered trademark of Sequoia contain the exact same artwork.

I haven't run that PR down, but the SEC action involving Sequoia (SQNT) is easy to find:

Neubauer was not mentioned. Did the suit you reference allege that he'd been involved with the SQNT pump, or that he simply used the (false or exaggerated) claims made by Sequoia to hoodwink Weisenberg and Inspar? Of course, he was a director of Baby Bee Bright, a Sequoia subsidiary. This is one of the old SQNT promo blasts:

It's all pretty unsavory, but there's no smoking gun in the form of judgments or the like.

As an aside, one of the people the SEC went after, Ashley Miron Leshem of Ananda Capital Partners, got a penny bar, but he still owns and operates Ananda. Maybe it's in another line of business these days. Maybe not.
