If a settlement occurs with a particular litigant over a certain share class, doesn't that have to carry over to other holders of that class, i.e. if Fairholme makes a deal to receive par on FNMAS, then all shareholders of FNMAS must receive par?

Also, although you may get a litigant who simply wants to go all the way in hopes of damages or other scenario not based in reality, it is likely that the major litigants will hammer out a settlement and that will include the best way to move the companies forward out of gov control so they can function safely as intended. I don't think a single or couple of stubborn litigants will prevent a solution.
