Because it's up to the sole discretion of the director, and the current director (Lew) is 100% against the release and has approx. 2 years left on his appointment, this is a rather large obstacle standing in the way of Mnuchin.

Since the signing of the SPSPAs, terminating the conservatorships is not up to the sole discretion of the FHFA Director. The information provided in that fact sheet is incorrect. The current FHFA Director is Melvin Watt. There are no statements from Watt that he is 100% against ending the conservatorships if allowed.
