REVISED GLOBALSTAR ORDER
GETS AT LEAST THREE VOTES
A revised draft Globalstar, Inc., order that was circulated to FCC Commissioners last week (TRDaily, Dec. 16) has picked up at least three votes, sources told TRDaily today.
FCC Chairman Tom Wheeler and Republican Commissioners Ajit Pai and Mike O'Rielly are believed to have voted for the item, while it was unclear late today whether Democratic Commissioners Jessica Rosenworcel and Mignon L. Clyburn had voted on it.
The revised order circulated last week reflected modifications that Globalstar proposed for the deployment of its terrestrial low-power service (TLPS) in the 2.4 gigahertz band using only its 11.5 megahertz of licensed mobile satellite service (MSS) spectrum and not also 10.5 MHz of unlicensed spectrum, as it had earlier sought and that drew the opposition of a number of parties.
Globalstar also recently agreed to technical changes and clarifications to its revised plan.
Since it has proposed the revisions, a number of entities that had expressed concern with the TLPS have said they won't oppose it. They are NCTA, the Entertainment Software Association, the Wi-Fi Alliance, the Wireless Internet Service Providers Association, the Wireless Communications Association International, and Sprint Corp.
However, the Hearing Industries Association and the Bluetooth Special Interest Group have continued to voice concerns.
The original draft order was circulated in May (TRDaily, May 13). Commissioners Pai and Rosenworcel voted against it, while Globalstar was believed to have the support of Chairman Wheeler and Commissioner Clyburn. But Commissioner O'Rielly had expressed concerns, depriving the company of a third vote.
In a statement released in June, Mr. Pai said he objected giving "a particular company special rights to unlicensed spectrum in the 2.4 GHz band. Bestowing this type of preferential access would be a marked departure from our successful and innovative approach to unlicensed spectrum." - Paul Kirby
