is effectively zero. They don't have the resources. To allege that there is an investigation going simply reveals that the person making such an allegation does not understand how things are done at the "commission".

The NNVC case is just too small. If you think about it from the perspective of a fisherman...you don't go to the pond where minnows swim. You go the the lake with the big fish. It's really that simple.

If we were talking about a big fish then other considerations come into play leading to a a final question; can a conviction be gotten? There is nothing worse for a career SEC investigator than wasting resources on an unwinnable case. Of course it happens, just a there are strike outs but you don't go to the plate looking for that.

NNVC has covered itself very nicely with all the appropriate language. Yes, they have gotten very close to stepping over the line - closer than I had thought but that's not enough for the SEC with insufficient resources to go after the big fish. And now, with a new administration the talk is resources are going to be cut further, and possibly drastically.

Waiting for an SEC investigation will be as fruitful as waiting for NNVC to produce a marketable drug.

The punishment will be rendered by the market.
