The ad does say several times that the product contains the patented Lacto-Freedom™

Where "Lacto-Freedom™" is a trademark. What is a trademark? It references the right to a name.

Yeah they use the word "patented". Does that refer to the super bug, or some other patent? At no point is there reference to a human gene carrying lactobacilli. If he ever made such a detailed reference, a complaint would be sent into the FTC for false advertising. Let them, and the FDA figure out if the super bug was really being used or not.

Where Kenny gets a little cute is in this passage:

Q. I take another probiotic, can I start Lacto-Freedom Probiotic right away?

A. If you currently take another probiotic, we suggest stopping it for 2 weeks before starting Lacto-Freedom Probiotic. This will give the Lacto-Freedom Probiotic a better chance of staying in the intestines.

It doesn't matter if one has Lactose intolerance or not. Everyone has their resident lactobacilli in the small intestine. Finely attuned to their host. Able to out compete probiotic bacteria ingested. So should one take a colonic purge to give the LF bacteria "a better chance"? Else Kenny is admitting what science already knows - introduced bacteria into gut unless pathogenic producing toxins, usually don't last long.

What's cute is the sales technique. Kenny is telling the buyer - stop taking your current probiotic. Throw out the half full bottle, and start paying $25/bottle for his.

Also interesting is:

Depending on the amount of lactose ingested, you may still need lactase supplements

Kenny's miracle cure falls short by his own admission. How about taking the $25, and buying 3 bottles of lactate instead?
