Yes fair points but here's some points to offset "some" of those concerns

A. Material claims through

B. CAFC has actually become MORE patent holder friendly over the last year plus (especially in regards to software), and in particular has been coming down pretty hard on the ptab for killing legitimate patents and claims.

C. CAFC review process is identical to district court (Phillips) and district court was more generous to us not less. There is a Much higher probability that the CAFC helps us rather than hurts us as their claim construction should hopefully align w DC Markman ruling. PTAB arguments could be quashed in a number of areas if we assume district court did not err in their opinion

D. As PP stated we may not even be involved w the CAFC on atvi until after DCourt. CAFC may only be applied to Bungie - I think this was a fair point by PP and tend to agree with it

E. There is always uncertainty around these stocks, but as someone who's taken his lumps and learned a lot from being VRNG and VHC I can say wddd is in a strong position for those who are patient
