Worlds Patents have been validated for the specific claims. In the eyes of the USPTO the patent claims are valid. The matter is closed by the Executive branch. This was the agreement between Worlds and Activision and since Activision is "not a party of interest" (USPTO's position) Worlds is free to continue the litigation. If Activision was to imply that they themselves should be added to Bungies Challenge they would likely invalidate the entire Challenge due to the Real Parties of Interest Conflict.
