XNRG entered into an agreement with the SEC to make that happen provided the proper steps are completed.

The agreement was accepted because it is in the best interest of shareholders as stated in the document that references the acceptance of the agreement.

The agreement would not be accepted and doing so being stated as being in the best interest of shareholders if it was not possible for it to some to fruition.
