Smart move! PTSCs case cannot be won and I took a close look at the appeals process and judge Grewal's decision to understand why. I think if folks actually read district court judge Grewal's decision they would see the light. Judge Grewal's decision took great pains to logically point out what is called a finding of fact. He found multiple disavowels that greatly narrowed the scope of the 336 patent. PTSC did this in over to overcome past patents that would prevent the 336 from being granted.

At any rate when an appeals court looks at a district court judges finding of fact they treat it with "deference". What that means is they assume it to be correct unless it is not logically argued and supported with facts. The appeals court does not take a fresh look at the facts and re try the case. Anybody who looks into this and rejects the PTSC pumpers would realize this.
