Powers made in the FOYJ Forum referenced posting by certain person or persons are completely false and totally without merit, and we consider that they may also constitute unlawful defamation. Mr. Powers has never engaged in any fraudulent or criminal activity either in connection with the Foy-Johnston Company (“FJC”) and Sandy Winnick or in any other instance or capacity. Mr. Powers has not received illicit funds or otherwise profited in any way through dealings with FJC and/or Mr. Winnick. Mr. Powers is in no way involved or implicated in any criminal actions prosecuted against FJC, Mr. Winnick and others in the US or any other jurisdiction.
