Then why is anyone still holding this stock which is guaranteed to go to zero and be cancelled? If you owned the stock during the class period, then you don't need to own it now. And if you didn't own it during the class period, holding it now through the cancellation by the court does nothing.
No matter the outcome of the lawsuits against the former CEO, it doesn't change the fact the common stock will be cancelled by the bankruptcy court. The Plan will be confirmed on November 9th.
And even if the ex-CEO does settle the lawsuit, it is questionable what, if anything, common shareholders would receive as the creditors and other classes are also suing him.
