I would think bankruptcy would preclude a CIC payout. BK is a place to pay back creditors, not give those responsible for being there in the first place golden parachutes. If you use that logic perhaps we can call the 1.40 options 'in the money'. They were close enough.....
Hopefully the Judge is fair minded and not influenced by PP. With that being said, any sane person with a grade school education can figure out PP's MO. Federal investigation and indictments for fraud and kickbacks with corrections officers pensions? 1500% profit for years? And it's in BK the judge is gonna say... 'well done thieves, impressive! So impressive I'm going to continue to reward you with 8 cent conversions in BK since it was in your contract.'
