So, the private placement letters have to be labeled confidential?

It seems like a Catch 22 then....if he says something privately that contradicts what is said publicly, or can't possibly be true, that would be selective disclosure, right? I know you don't agree that was the case for the first private letter and I don't want to rehash that, but in principle, isn't that true?

Let's say a private letter claims to have found baseball-sized gold nuggets laying on the ground surface. But in public, the company says that no free gold has been found, only geochemical traces. Or says nothing at all about gold nuggets.

Not saying that was the case here, but just as an example, isn't that selective disclosure?
