The problem as I see it, is that nobody knows what the documents say. Certainly, the judges, except for Judge Sweeney, only know that there are thousands of documents out there that the federal government is desperately trying to hide.
By the way, in listening to the interview with Bruce Berkowitz, he seems to be offering the government a deal: Either restore the preferred dividends or we will use the release of additional documents to cause as much trouble for you as possible.
