If you want to use the word fraud I would say that is not the worst word to describe what he did with the cell. Probably he thought he could make the cell much faster and cheaper than he really could despite having no scientific expertise or experience. When reality set in (this should have happened around 2013 far before he mostly shut up about the cell) and he realized that all the promises he had made about the cell were not going to happen, they just slowly stopped making as many promises (not dispelling previous false promises, just less new promises) while letting people believe they were still going to change the world of solar. That's how I see it. Fraud is not a bad word.

Part of suing someone for defamation includes a period called " discovery " where the party being sued is allowed to get information from the plaintiff. This would include things like all the information they have about the development of the cell, which I could compare to their public statements.

This is why I can say confidently that I believe Nelson ripped off his shareholders to benefit himself and his buddies. Had he been truthful with shareholders he would have said a long time ago that the cell wasn't going to be able to live up to the claims they made previously. He still has not done that, and I suspect he will never do that because he needs this company to fill his retirement fund.

As I have been saying for almost two years now, if he wants to prove the cell exists and dispel doubt it would be very easy to just invite the press and show off the cell and what it can do. Instead he just refuses to answer questions about it, shuts down the Santa Barbara office and lays off the only scientist they had working on it.
