Simple answer. Practically anyone can be deposed during a discovery process. They want input from both sides of the isle.

The big question is why would anyone file a lawsuit, much less a class action, unless there was something to be gained. Texas has ironclad Homestead Laws that protect the primary residence. That's where PIs get involved. Much cheaper and IMO much more thorough without anyone knowing that potential assets are being investigated among other things.

Of course, a person or a group could have one filed just to make someone's life more miserable than it already is. Happens all the time.
