Here is how I think it will play out: The Court of Appeals will say that if the federal government wants to liquidate FnF, then it must fairly compensate the shareholders for the 20 percent ownership that they do now have, given that the companies are doing well.
Liquidating the companies otherwise amounts to confiscation.
Note carefully that the confiscation has not actually taken place-when it does, then you will see another round of lawsuits.
