as a non lawyer
it was my impression that discovery in the Claims court does not have a lot to do with the merits of the case
it was/is my impression that the GOV argued that the case did not belong in a Federal Claims Court for reasons A B C D --- (I can not lay out)
the plaintiff - Fairholme - argued that ONLY with discovery can the court decide if reasons A B C D to toss the case are legit
So as with all the cases - this one - including its discovery - is still battling CAN IT BE TRIED
?
am I wrong in my impression that the discovery relates more to the decision to go ahead or not? (something like - ? - are Treasury and FHFA joined at the hip?)
