"I would believe this to be a very straight forward and simple question"

I believe this to be a very difficult and complex question. There is no direct precedent for the court to rely on. Therefore, they will need to search cases to find similar situations they can put to use. This plus the fact they probably have a dozen other cases to make opinions on.
