Not true...the judge threw the case out (if you are talking about Ken's case against the auditors) because a private citizen cannot pursue a publicly traded company for fraud unless they are harmed. The judge ruled there was no harm because the audits said Rod had no shares at the time to sell, and that was the public information available at the time.

The judge never put forth an opinion on the real estate or the veracity of the audits.
