You're right unfair is not a reason, unless you consider the AIG suit whereby unfairly treating AIG over all the other bailout recipients; through excessive interest and substantial ownership of the company allowable through warrants, was decided as an abuse government power.

The idea that those terms were legal was struck down by the judge however no damages were awarded and it is now in a state of appeals.
