...they have insurance to cover claims (Class Action judgment)... no lender would give them a dime without proper Professional Liability and Directors & Officers Insurance in place...

In addition, if it is egregious enough to the SEC they will go after them civilly i.e. personally...follow the $ and take assets...

I was one of many plaintiffs in one such SEC enforcement action and they sued for Investors and traced illegal gains and grabbed the principals perpetrators assets (including homes)... 3O% was returned to investors...without investors spending a dime.

One defendant appealed the civil judgment and got it reduced...just pissed off the SEC Enforcement attorneys to the point they made a criminal referral to Justice Department...now they want her ass in jail and have interviewed witness for the criminal indictment expected in October...(still after taking a chunk of her money).

The only one who escaped $ judgement was an officer who voluntarily rolled over...and spilled the beans got immunity and walked away unscathed. Maybe one of the ANY "players" wants a free pass and will make it easy going after the others... :)
