The courts must determine if the FHFA actually acted as a Conservator. If they determine that the FHFA acted as anything other than Conservator, HERA cant protect them.
That is why, as I said, the most important issue is whether or not the actions taken by the FHFA are actions authorized to be taken by a Conservator. The courts will determine this and it will pretty much decide the case.
My contention is that they were acting as a Receiver but under the cloud of Conservatorship...which would legally make them neither a receiver or conservator.
Hopefully the courts agree with me!
