The judge never ruled on the actual facts of the case brought up by Ken, he only ruled that Ken was not harmed; therefore he cannot bring a private suit for fraud.. only the SEC can pursue a company for fraud.

Anyone interested in the truth can read the judge's opinion and find out for themselves.
