My observation stands..as he wants shares of ECIG common stock too...whereas he could have just requested cash equivalents.

You may be reading a little too much into this. Here's what he's asking for....

Plaintiff respectfully requests that this Honorable Court enter a judgment against Defendant in the amount of $298,250 and order the issuance of 75,000 shares plus costs, interest, and attorney fees.

The cost of the shares are a token and represent less that 5% of what he's asking. The shares probably have more to do with satisfaction than anything else.
