A contingency is even laughable as the defendant had no way up until filing a countersuit and that wasn't done until the case had been around for over a year.
When this case started Dimension claimed statute of limitations and that transpired for over a year. In fact the time I went to Las Vegas to see the hearing (4/14) there was a new judge (Ellsworth was replaced by Gonzales) and even though Dimension proved TMMI knew that others owned the license from year 2000 through 2008 she continued the case and the statute time limit was completely ignored. Therefore (IMO) Dimension didn't even have a countersuit position for over a year and a half.
