As you may have seen. Patent 14/668957 was recently issued a final notice of rejection that included the rejection of all claims but one (claim 8). Claim 8 was objected by the examiner but was sited as allowable patentable material.Essentially all of the claims on the patent are similar but each claim attempts to get more specific however claim 8 seems to be the broadest of all "The system for contact lens wireless communication of claim 1, further comprising an antenna assembly adapted to greatly amplify the wireless signal transmitted and received, wherein a lens antenna is positioned on the outer perimeter of said contact lens, a top antenna is positioned in an external device cap, and a bottom antenna is positioned in said external device." The examiners always look for the broadest scope so the patent covers the largest amount of space so other cannot do the same thing without infringement. In our situation it was notated that claim 8 would be allowable if it did not cite the reference of claim 1 in the claim (since claim 1 was rejected). If the claim 8 is rewritten to exclude said claim the claim will be considered allowable patentable material. In order for EPGL to move fast in getting this approval all of the other claims aside from 8 will need to be formally canceled and continue the application based solely on claim 8. However there are multiple ways in which they can approach this and they still have the ability to object the final rejections. The easiest correction is to continue on the claim 8 being the only objection.
