It has been argued here that the lawsuit has zero to do with filing, but what you have neatly cleared up for readers is that the lawsuit, and holding off on filings has everything to do with the lawsuit.

Why would HJOE file to allow KBM to dump, which is what you said would happen. So they could start a death spiral? Yes, that is a sensible thing for HJOE to do to SH.
