The whole point of a conservatorship is that no-one has fiduciary duties because the Conservator is permitted to do whatever they need to to fix the company.

Usually though, the directors have the fiduciary duty when not in Conservatorship.

Fiduciary duties dont always exist. That isnt to say other types of duties dont though. There are plenty of duties here...statutory, contract, heroes.

My opinion on the appeals case is that it is the whole enchilada. Every pending case is going to follow suit with how the appeals case rules.
