Yeah, I think it really just depends on the patent...

Look at StrikeForce Technologies...another play I'm in. They are a small computer security company. They patented a form of multi-factor authentication and have some software based around it.

Microsoft bought a company who apparently was infringing on that patent so they ended up suing Microsoft over it. They ended up receiving just under $10 million in that settlement with Microsoft and are now working on filing more suits against infringers now that a precedent has been set. PLUS, now their legal firm is working on a contingency basis. The first suit, they had to pay as the services were performed.

I don't know how a suit over NTI/Hybrid's patents would go, but it very well could go well for them.
