There may be a compelling reason for the entire settlement to have been invested in a legal defense fund. But I did not see it in this press release.
It's possible that financing for the first year of production, marketing and distribution had been cemented with prior agreements.
It's also possible that DECN and JNJ cut a deal to jointly use the TOV patents to legally attack the other strip providers. But that seems like a stretch to me.
So, bottom line - I'm concerned about this too.
