This is interesting, the USPTO seems to be a very scared now hey?

Here's the answer I posted to the board a while back to which no one answered.

Issue relates to En Banc odds

Notably, the unanimous panel of Judges Moore, Taranto, and Hughes (author) held that neither the software-implemented data structure nor its method of creation were “directed to a patent-ineligible abstract idea” and thus did not pass Step-1 of Alice/Mayo.

The fact this was unanimous limits the odds of an en banc hearing. In order for this to be overturned it will likely have to get to scotus, who in my view would not. This is an accurate and correct ruling and great for patent holders, especially given the ruling was unanimous.
