Depends on if a R/S is undertaken irrespective of the PTAB validating the patents.

I mentioned prior, that:

1. Given the financing for the PTAB costs has likely already been accomplished via issuance of shares, there is no need to undertake a R/S for financing reasons

2. In addition, given the exchange they are on, market cap means very little so there is no 'need' to do a R/S to finance regardless

3. The company did mention in the past and currently that the real reason for an R/S would be to uplist. Thus, they would clearly have a catalyst (ie PTAB ruling in their favor).

I agree with your logic but I don't see Kidrin doing a R/S 'just because'. Rather, the likely reason will be to uplist to the Nasdaq, and implicitly this would assume that the case is moving forward because patents are valid. As such, given the reason, the stock will likely be rising not falling.

If he undertakes a R/s without that catalyst (which as I explained really doesn't make much sense at this stage), then yes your logic is sound.
