The Supreme won't even look at this case until

A. En Banc is accepted or rejected

B. If accepted then it goes through that appeal process (CAFC)

C. If rejected then likely MSFT will appeal to SCOTUS but needs to submit a Writ of Certioari.

D. If accepted En Banc and reversed, then it is remanded back to the district court and then Enfish can appeal to the CAFC then Scotus

The appeals process as a whole will take at least a year to two (closer to 2) years all in.
