With the recent volume I started some digging again...

Googled Peter Berney and hit the obituary link and this is first on the list...

It's been confirmed that Berney died December 15, 2015 and that is him in the above link. I also heard that the free trading shares are around 55 million and just sent an email to info@empirestock.com to confirm and will post if/when I hear back. In the meantime I'll trying calling Barton to see what else, if anything, I can find out...
