Several factors go in consideration

1- Biod 531, 123 and glucagon will lose value as time passes by
2- lawsuit with Unilife costs money to litigate and at the end it is with a company that could go BK, if it is going to shell out $50M .. At present you can collect $5M including legal fees .. So, is it prudent to go last mile with UNIS and drub them BK ?? .. Most likely, it is more beneficial to have UNIS deliver the needed syrenges ASAP , so GEM line becomes viable again and also get some cash for settlement
3- interested party for Biod pipe wants to develop pipe ASAP and not wait a couple of years for a pending lawsuit which its outcome is not certain in terms of how much cash would give to Biod
4- Unilife new management is also highly motivated to settle now as Biod has incentive to settle , rather than dealing with a deep pocket take over player of Biod
