Not that my opinion matters, but I think they have a strong case for the arbitration that may result in $30-50M cash. And you are probably right. Even if they win, they may not get the money right away.

However, if they can survive until the arbitration without dilution, with a positive arbitration result, the stock will skyrocket. Even if they can't get the money right away, It would make more sense to offer shares at higher prices to raise money with minimum number of dilutive shares. In that scenario, they may even go after a short term financing without any share offering, until they receive the money.
