We all know a lot about what Amazon can do than what they think they can do ..LOL.

Court cases are based on the evidence and not the future growth etc. Currently Staples and Office Depot are 1 & 2 in the market and with big contracts. That is how FTC has based its case.

Staples and Office Depot are in a bad situation as they cannot present evidence because the evidence will prove that their growth prospects are nil and Amazon will take over them very soon. So they took alternative route "dismiss the case based on antitrust". If evidence is presented then Staples share holders might sue the company for buying ODP with this knowledge.

Executives at Staples and ODP wants to win the case so that they can sell their stocks at a much higher rate...which I think is normal with any senior management.
