well the judge did say that fixing the regulations would be enough, so the government could do that easier than making and passing new legislation which they need to do with legalization

Health Canada can still regulate medicinal cannabis, just not so strictly as they tried with the MMPR

and of course, if the new regs are challenged the government may have plenty of evidence that wasn't available at the beginning of the Allard challenge - they may have a better case for a little restriction
