That's not true,at all. Preferred shares were actually paid, as originally announced prior to conservatorship, after September 6, 2008. Preferred share dividends can be restored while the GSEs remain under conservatorship, simply by the courts repealing the 3rd Amendment or by FHFA modifying Amendment 3 with a new Amendment 4 that permits such action.

Court action may also restore postponed or eliminated dividends following conservatorship imposition to preferred shareholders.

There is far more certainty in the still risky preferred shares than in common Fannie and common Freddie. Both FNMAS and FNMAT living large, today.
