And even if they do, the ultimate decision is up to FINRA, who would likely confer with the SEC about it. MIKP's long effort to get back on the Pinks is a good example. The stock was suspended in 2012. Eventually, the company--which before the suspension had been a Pink--went to the trouble to file a registration statement with the SEC. The registration statement became effective.
MIKP then found an MM willing to file a Form 211. The MM in question gave it his best shot, but FINRA asked more and more questions. Finally the MM withdrew, saying he couldn't waste his time on it any longer. MIKP voluntarily deregistered by filing a Form 15 with the SEC.
During this entire time--from September 2012 to the present--MIKP has been Grey. That seems unlikely to change.
