On Dec 19, 2015 ANI’s lawyers responded to the non-final rejection. It was forwarded to the examiner Jan 21, 2016. Looks like a good argument, but with the patent office, logic doesn’t always sink in, as noted by 75% of cases being won on or before reaching the Patent Appeal Board.

On Jan 6, 2016 ANI’s lawyers submitted that response after final action. The patent application appears to have been headed for appeal process. However, they received an Advisory Action Before Filing an Appeal Brief from the examiner on Jan 22, 2016.

It cites that an amendment was made to a claim that requires further searching to assess it’s allowance. I imagine they will have to submit Request for Continued Examination and see what the examiner comes back with.

I usually check the progress of the patent applications weekly and just they are just appeared on the website within the last week. Usually they post items within a couple of days. With everything going on, I wonder if they had meetings which have not been posted.

Could this have anything to do with AVARX taking down their advertising of Libigel as a licensing opportunity, in December.
