There will be a ton of posts today, so I'll add a few of my thoughts.
We truly don't know what 'part' of Ocata Astellas is really interested in.
If it is related to phase 1 clinicals, there are miles to go before possible commercialization there, let alone FDA approved in the good old US of A.
SEC documents clearly said Ocata was officially marketed by two major firms for over a year, probably from the first day wotton was hired if the truth were to be known and ONLY Astellas emerged.
Anecdotal observation of basically JV and/or financing repeated failures for years, sure says a lot, imo.
It seems pretty obvious litigation looms and Ocata is just doing everything it can to protect their butts in the eyes of some Delaware judge, if it even gets to that point.
Given Astellas's almost 90% premium, my 'guess' is if necessary a modest higher bid my well be in the cards.
I totally agree with Kirk's take on the Gabelli action.
ACT/OCATA has sure been 'fun' for 10+ years and the saga continues.
This could easily be the stuff for a movie.
Soon the possibility wotton may well be canned and walk away with millions, so 'they' always 'win', like the crud rabin. Retail shareholder investing is sure fun.
