It surely looks like a Collusion unless Lehman is stonewalling and JPM had no option but to go with this submission hoping Sullivan will never allow this farce and will force the settlement with Lehman on this issue, according to guarantees in prospectus... Looks like it has come down to Judge Sullivan being the Judge, Jury & Executioner literally in this case now, if us CT Holders are to have any hope of the prospectus guarantees being enforced / Dodd-Frank being enforced as far as Capital Trust securities laws are to be enforced for a Bank Holding Company.
